About Mediation:

1

When may this be an appropriate service to seek out:

  • To resolve or address supervisory concerns that arise between a supervisor and supervisee.

  • To navigate differences that may be straining a workplace relationship.

  • To address challenges or conflicts between a practice owner and a employee or contractor especially upon separation or termination as it relates to care for existing clients and verification of work experience and/or clinical supervision hours.

  • To tackle disagreements and/or navigate growth or changes experienced by business partners.

2

Some things to keep in mind about mediation:

  • Mediation is voluntary, confidential, and requires openness and effort on the part of all parties.

  • A mediation agreement is not legally binding.

  • The focus is on reaching an agreement or compromise, not assessing or assigning blame.

  • It can be more efficient and affordable than seeking legal remedies.

  • In addition to my legal and clinical background, I completed a 40-hour mediation certification program in 2017 and am confident and competent in providing mediation services.  It is important to note that this is a service distinct from practicing law and does not constitute legal advice or representation.

3

Process:

  • Complete the request to book behavioral health workplace mediation form or email info@clinicalbestpracticeinstitute.com.

  • Once reviewed, I will reach out to both parties in a joint email to confirm their willingness to participate and have each complete a questionnaire to ensure the appropriateness of mediation services.

  • All parties must sign a consent to participate in mediation accepting and agreeing to the terms of confidentiality and for a limited mediation summary to be provided to both parties following the session(s).

The Investment:

  • Once the request to book as been confirmed and questionnaires have been completed, the initial 90-minute mediation session will be scheduled and a non-refundable fee of $350 is due.  This fee can be paid by one party or split between the parties.

    • The initial mediation session will be a joint session unless decided otherwise in advance.

    • Some agreements can be reached and conflicts resolved within the initial session and if so, a mediation summary will be completed.  If subsequent sessions are needed and desired a mediation plan will be outlined.

    • Subsequent sessions may be scheduled as 60, 90, or 120 minute sessions depending on the plan and fees for subsequent sessions will be $200/hour. This fee can be paid by one party or split between the parties.

    • All mediation sessions will be provided via Zoom unless otherwise requested and agreed upon.  Please note that in-person sessions may result in additional costs.
